||The hearing just sums up the motion for reconsideration as the court gives 15 days for the prosecution to comment about the Motion for Reconsideration filed by the accused and another 15 days for the defense to reply.
Also, RJ Bautista's lawyer made an oral motion to ask the permission of the court to grant him to attend the 2nd Death Anniversary of his brother, Ramgen. The Court GRANTED this motion with no objections from the state prosecutor. RJ Bautista is hereby granted to leave jail premises on Oct. 28, 2013, Monday from 10:00am to 8:00pm.
The order dated Oct. 18, 2013:
...In today's hearing on these incidents: (1) Motion for Reconsideration filed by accused Ramon Joseph Bautista; and (2) Motion for Reconsideration for accused Glaiza Visda, through their counsels, re the Order of this Court dated September 4, 2013, all the concerned accused appeared, except accused Ramon Joseph Bautista and Ryan Pastera, Attys. AJ L. Gepte and Clarrissa Castro also appeared. The court notes the manifestation of Atty. AJ L. Gepte, counsel for accused Ramon Joseph Bautista that the non appearance of the accused despite due notice can be dispensed with so that the proceedings can continue.
At this juncture, the Hon. Prosecutor asked for time within which to file their comment on the said motions. The People then are given fifteen (15) days from today within which to file comment to both motions furnishing copy to the accused Ramon Joseph Bautista and Glaiza Visda through counsels who upon receipt shall be given likewise fifteen (15) days within which to file their reply. Thereafter these incidents shall be deemed submitted for resolution.
Meantime, the scheduled settings re the main case is held in abeyance pending the resolution of these incidents and until further notice.
Also, at this juncture, the defense counsel for accused Ramon Joseph Bautista moved in open Court that an Order similar to the on issued last year to accused Ramon Joseph Bautista be again issued granting the said accused the same furlough or time within which to visit the dead, particularly the victim in this case, on October 28, 2013 starting at 10:00 o'clock in the morning until 8:00 o'clock in the evening. With conformity of the prosecution, the motion is granted and Senior Insp. Bernardino Edgar T. Camos, Jail Warden, Special Intensive Care Area (SICA), Camp Bagong Diwa, Bicutan, Taguig City, is hereby allowed to let accused Ramon Joseph Bautista to visit the deceased victim in this case at the cemetery on October 28, 2013 between the hours of 10:00 o'clock in the morning and 8:00 o'clock in the evening with proper escorts to be provided in connection therewith.
